Zdravo.
Imam situacijo,da sem leta nazaj kupil stanovanje prek prijatelja,ki je dobil sluzbeno stanovanje po res nizki ceni.recimo 25000 EUR.sedaj bi to rad prepisal name.
Takrat sem mu nakazal 20000 kot posojilo,5000 sem mu dal na roko.rad bi izvedel prepis brez plačila kupnine,ki je niti nimam.
Ko seštejemo mi pride davek in notar(ocenjeno je stan na 50000 EUR) oko 6500eur,in to imam.
Kako bi zgledalo da ne plačam kupnine.kako to urediti da bo najboljše.ce dam na kupoprodajni 25000 ,bo,ceprav je res nakupna cena iz 2017,FURS dal svojo ceno oko 50k.
Kako torej to rešiti,če imam denar samo za davek in prepis?

To pa res ni problem. Ampak je tako...
Gresta k notarju (lahko tudi sama sestavita pogodbo in notar samo overi (je malenkost ceneje).
V pogodbi pač napišeta, da si plačal v gotovini.
Potem pa prodajalec dobi položnico da plača davek. To najbolje da on da tebi in ti plačaš davek, da boš ziher da je plačano. In ko je to plačano, šele takrat si potem lahko vpisan v zemljiško knjigo, drugače te ne vpišejo.
Vrednost za izračun davka vzamejo katera je višja (se pravi če je po gursu 50k, boš plačal davek od te vrednosti).
V pogodbo pa kar zapišita še zemljiškoknjižno dovolilo.

xgego, lahko samo sanjaš o tem. Davek na RVC bo plačal od vrednosti nepremičnine in ne od tega, kaj ona dva napišeta v pogodbo, jasno pa še 2% DPN , ki je vedno.
